Paratype vs Yauza Publishing

In 2013 We became aware of the fact that Yauza Publishing House published A. Tereshchenko's book «The Smerd's Purgatory." Stalin's «wolfhounds», on the cover of which the inscriptions (the author's name, the title of the book, the title of the series «War and Peace») were made in the font «Rodchenko» («Rodchenko»). Permission for such use of the font The plaintiff did not give the Respondent, but for written notification of the committed offense he replied that he did not recognize the violation of the exclusive right of the Claimant, referring to the fact that this font is freely available on the Internet, and also that the font was is installed on the designer's personal computer, which does not belong to the publisher.


The court of first instance recognized as proved the fact of violation of the exclusive right of the plaintiff, and recovered compensation from the defendant.
